Last week, the EPA approved California’s proposed glyphosate product warning language Bayer Monsanto has refused to add any warnings to their Roundup products especially those that would call out potential health risks related to the active ingredient glyphosate. To the point, that they are considering removing this product from the consumer shelves to focus on commercial users.
This is a big victory and could affect the Solicitor General's recommendation to the Supreme Court on whether they should review the Hardeman case. Federal preemption was one of the reasons they wanted the SC to reverse the decision along with trying to get the plaintiff's expert booted. This is just the beginning, and it will be interesting to see what states follow California in recognizing IARC's opinion on Glyphosate.
As of last month Bayer does not appear to be willing to let another Roundup lawsuit go to trial if the Plaintiff has shown exposure to Roundup and has Non Hodgkins Lymphoma. Last week, Bayer agreed to a settlement to resolve a group of Roundup lawsuits in St. Louis, Missouri right before trial.
